What am I licensed to do with a non-exclusive license?
You may add lyrics to the existing Master Recording and Music, create a New Song, give the Song a New title, and register the New Song for copyright.  

How do I handle the new copyright?
The new copyright embodies music that was already copy written, so the new lyricist needs to register it again.  Contact Shaun for his previous copyright registration details. www.copyright.gov

Who owns the music in the New Song created after I add lyrics?
Producer (Shaun Friedman - ASCAP) will be considered the author of the Music and thus entitled to fifty percent (50%) ownership to the Song.  You are the owner of the lyrics and also entitled to fifty percent (50%) ownership to the Song.

Who owns the master recording in the non-exclusive license?
Shaun Friedman retains the rights to the master recording in a non-exclusive license.

Can Shaun sell the beat to multiple people after I purchase a non-exclusive license?
Yes, Shaun can license the master recording and music to as many people as he wants.

If you want a true, exclusive track that is sold one time only, you should purchase an exclusive track agreement.  A non-exclusive license is good in cases where you need to showcase your talent for an affordable price and also for demo or promotional purposes.

What type of files do I receive after purchasing a non-exclusive license?
You will receive the un-tagged mixed and mastered 24 bit .wav file.  The previewed track will stream online as an Mp3 file with a voice tag.

Why is Shaun putting a voice tag on his streaming mp3 track previews?
This is not something that Shaun wants to do, but is currently doing to protect his compositions.  He has tried to blend in the voice tags not to ruin the vibe or take away from the beat, but to actually enhance it.  All purchased tracks have the voice tag removed.

Does the non-exclusive license call for any royalties to be distributed to Shaun?

Why is an exclusive license more expensive than a non-exclusive license?
In simple terms, it's more expensive because it\\\'s only being sold one time to one person or company, Shaun transfers the rights to the master recording to you, and you receive the \\\"tracked out\\\" separated 24 bit .wav files delivered in a ZIP package in addition to the un-tagged 24 bit mixed and mastered .wav file.  A non-exclusive license can be sold to multiple parties and you do not receive the tracked out .wav files.  Shaun also keeps his rights to the master recording in a non-exclusive license.  An exclusive license clearly holds more value.

Who owns the master recording after agreeing to an exclusive license?
Shaun Friedman relinquishes the rights to the master recording but keeps the rights to his music.  This means that the master recording is transferred to the artist or label so they can exploit it without restriction.  

Does Shaun also relinquish his rights to the Music?
No.  Shaun keeps his rights to the Music.

After adding lyrics, what percentage of the song does Shaun own?
Shaun owns 50% of the song since the music is 50% and the lyrics are 50%.

What exactly are we paying for when we purchase an exclusive track?

Does the exclusive agreement call for royalties due to Shaun?
Yes, Shaun receives a royalty on the sales of recordings.  This also means that Shaun receives a percentage of the net receipts for any exploitation of the masters or any flat fee paid for the masters.  Because Shaun retains the ownership to the music, he is also paid a Mechanical Royalty.  Shaun is paid one half of the mechanical royalty (and other royalties like performance, synchronization, etc) because he owns one half of the song for the music.  The artist receives the other half for the lyrics. 

Does an exclusive license require a signed agreement?

Why do other websites offer non-exclusive licenses and exclusive licenses at the same time, for the same track?
We aren\\\'t sure.  Shaun Friedman offers dedicated exclusive tracks that will only be sold one time exclusively with a signed agreement.  This way your track is not licensed to 10 other people non-exclusively and then you come along and get the exclusive rights.  Exclusive means exclusively yours only, and gives you peace of mind.  

What does an exclusive license mean in lamens terms?
An exclusive license says that nobody else is going to have this particular music.  This is a license that says this track is yours and is exclusive to you.  It also requires a signed agreement.

What is a Custom Beat?
A custom beat is created by Shaun specifically for you after Shaun reviews your custom beat questionnaire request form.

Why would I want a Custom Beat Exclusive License?
You would want a custom beat when you have a specific vision for what you want your song to sound like.  On the other hand, if you have a couple basic instruments picked out and have somewhat of a description, Shaun will put the pieces together.  The more detail you give, the better equipped Shaun will be to produce your next masterpiece.  Shaun views this as a personal challenge, and will do everything in his creative power to produce a track you are satisfied with.  It\\\'s obviously in his best interest to create a one of a kind production that a company or artist is pleased with.  If definitely gives an added personal touch and it will take the direction you want to take.

Does a Custom Beat Exclusive License have the same contract terms as an Exclusive License?
Yes, with one difference.  In a custom beat agreement, you (company or artist) are the Employer, Shaun is the producer, and the master recording will be considered a work made for hire by signed agreement.  In an exclusive license, you (company or artist) are the Client, Shaun is the producer, and the master recording is transferred to you by signed agreement.  This is because an Standard Exclusive License (as opposed to a Custom Beat Exclusive) usually deals with tracks that are already produced and are available for purchase online; Shaun has already copy written these tracks.  At the end of the day, the Employer or Client owns the master recording in both cases.

How long does it take to have my Custom Beat ready for download?
This can take anywhere from a couple days to a week and depends on the information you submit in the Custom Beat form.  The more detail you give, the better equipped Shaun will be to focus in on your specific vision and get his creative juices flowing.

No.  You will only need to pay if you decide to hire Shaun to produce your custom beat.

Will my down payment be refunded if I don\\\'t like the initial beat that Shaun demonstrates to me?
No.  This is a non-refundable payment for Shaun\\\'s time in the studio.  After the initial demonstration of the progress of the instrumental, he will do his best to make any minor changes, and if the direction he took is totally off base, he will only attempt it one more time.  So, if you like the initial production, he will listen carefully to your instructions on how to fine tune it and complete the project.  If you don\\\'t like the initial production at all, he will give one more shot at it.
